Yonah Walls & Ceilings, Inc. Limited Warranty COVERAGE This Limited Warranty covers all work performed by YONAH WALLS & CEILINGS, Inc. ("Yonah"), its employees, contractors and subcontractors. For a period of ONE (1) YEAR beginning on the date below (effective date) for the work performed at the location address below ("Location"), Yonah will correct or repair any of the “covered items” described hereon without cost except as noted. This Limited Warranty is transferable within the original One Year period, but shall not extend this warranty past its original period. COVERED ITEMS One time during the One Year Warranty period, upon notification Yonah will correct or repair in a manner that is consistent with common practices and industry standards for the class of work performed, any defects in the work as described on the invoice for such work, except as follows: • Damage due to misuse, abuse, accidents or events covered by insurance, modifications not performed by Yonah, and acts of God; • Manufacturing defects in material used unless specifically covered by written agreement (such defects shall by covered by the Manufacturer); • If any payment for all work performed by Yonah at this location is outstanding and not paid within the terms of payment, whether contested or not; • If there is any unresolved litigation, class action or other legal matter concerning the work or material; in such case, the settlement shall supersede this warranty. REPAIRS and CORRECTIONS ONCE during the One Year Warranty period, upon notification as described hereon, Yonah will in a manner consistent with common practices and industry standards repair or correct covered items without charge. Yonah is not responsible for work not performed by Yonah even if the repairs or corrections require finish work (i.e. painting and trim) to be performed. The following are examples of typical repairs and corrections: • Cracks, nail popping, trowel marks, cracks due to settling, in drywall, except in cases where there is excessive movement due to faulty construction; • Sags in suspended ceilings; • Failures in product installation or workmanship; • Similar minor defects that occur as buildings settle under normal circumstances. NOTIFICATION Upon contacting Yonah within the One Year Warranty period, we will schedule an appointment to assess the work to determine the repairs or corrections that may be covered by this warranty. Yonah will schedule a time mutually agreeable to perform the covered repairs or corrections even if repairs or corrections extend beyond the warranty period. WARRANTY LIMITATION This warranty does not cover damage or defects resulting from accidents, negligence, water, fire, manufacturing, medication, or intentional acts. No work or materials supplied to repair or correct defects under this warranty shall extend this warranty beyond its original period. YONAH WALLS & CEILINGS, INC. MAKES NO EXPRESS WARRANTIES OTHER THAN THE WARRANTY SPECIFIED HEREIN. ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTY OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE DENIED. The financial limitation for all claims under this warranty shall be limited to the amount paid to Yonah less material cost.
